2、 According to the Labor Law of PRC and relevant laws and regulations, Party A and Party B sign this contract on the basis of equality, free will and mutual consultation. 一、 工作內(nèi)容 Article One Working Contents 1.1 甲方因生產(chǎn)需要，同意聘用乙方為本公司員工，職位為 。乙方同意接受該安排，遵守勞動 紀(jì)律和職業(yè)道德，執(zhí)行勞動安全規(guī)程，提高職業(yè)技

3、能，完成生產(chǎn)（工作）任務(wù)。 To meet the production demand, Party A agrees to employ Party B as . Party B agrees to accept the arrangement, observe the labor discipline and professional ethics, carry out rules of safe operation, improve professional skills and accomplishes production tasks. 1

4、.2 甲方可根據(jù)生產(chǎn)經(jīng)營需要依法調(diào)整乙方的工作崗位或職位。 Party A may legitimately adjust Party B’s post according to business requirements. 二、 合同期限 Article Two Term of Contract 本合同自 年 月 日至 年 月 日，其中試用期為 個月（自 年 月 日至 年 月 日）。勞動合同的期限屆滿或約定的終止條件出現(xiàn)，勞動合同即終止執(zhí)行。經(jīng)雙方協(xié)商一致的，可以解除或續(xù)訂勞動合同。 This

6、Both parties may rescind or renew the contract via mutual consultation. 三、 工作時間 Article Three Working Hours 3.1 甲方實行每周工作40小時和2天休息日（可能非星期六、日）的標(biāo)準(zhǔn)工時制度。 Party A carries out standard working hours system of 40 hours per week and two rest days (maybe they are not Saturday, Sunday). 3.2 甲方因工作

7、需要，在乙方愿意的前提下，可依法安排乙方超時工作或公休日加班。 Party A may legitimate arrange Party B to work overtime or work on general holidays due to business requirements on condition that Party B is willing to do so. 3.3 甲方由于工作需要更改工時制度，經(jīng)政府有關(guān)部門批準(zhǔn)后，乙方應(yīng)密切配合執(zhí)行。 Party A may change working hours system for business requir

8、ement after approval by relevant government authorities and Party B shall execute it of his own will. 四、 薪酬 Article Four Remuneration 4.1 甲方支付乙方的每月基本工資為人民幣 元。上述薪酬不包括甲方按公司補(bǔ)貼規(guī)定按月向乙方支付的所有補(bǔ)貼。 Party A pays RMB to Party B as basic wage per month. The aforesaid remuneration exclu

9、des all subsidies paid to Party B pursuant to Party A’s stipulation. 4.2 甲方嚴(yán)格執(zhí)行國家有關(guān)最低工資的規(guī)定和標(biāo)準(zhǔn)。 Party A shall strictly implement relevant regulations and standard per the lowest wage. 4.3 甲方的發(fā)薪日期為每月 日。 Party A shall pay the wage on the day every month. 五、 勞動保護(hù)與勞動條件 Article

10、 Five Labor Protection and Labor Conditions 5.1 甲方須對乙方進(jìn)行勞動安全、業(yè)務(wù)技術(shù)及勞動紀(jì)律等方面的教育和培訓(xùn)，并根據(jù)國家對勞動保護(hù)、安全生 產(chǎn)的要求，為乙方提供必要的生產(chǎn)（工作）條件，保障乙方的安全健康。 Party A shall give Party B education and training programs relating to labor safety, professional skills and labor disciplines etc. According to the requirements of

11、 state labor protection and safe-production, Party A shall provide necessary working condition to ensure Party B’s safety and health. 六、 社會保險和福利 Article Six Social Insurance and Welfare 6.1 甲方依法替乙方辦理各項社會保險并繳納保險費用。但依法規(guī)定之分?jǐn)偙壤瑢儆谝曳巾氉孕胸?fù)擔(dān)之各項 社會保險金，由甲方于每月發(fā)薪時，從乙方薪資中代扣代繳。 Party A shall transact soci

12、al insurance and pay them for Party B. Party A shall withhold the social security contribution legally undertook by Party B when paying the remuneration every month. 6.2 乙方享有國家規(guī)定的所有法定假日。 Party B will take all statutory holidays stipulated by the State. 6.3 甲方實行年休假制度，乙方連續(xù)工作滿一年以上的可享受有薪年假，申請享受辦

13、法按公司甲方制定的年假規(guī)定執(zhí)行。 Party A carries out annual vocation system, Party B can take paid annual vocation after continuously working for 1 year and the applying procedure for annual vocation shall be done pursuant to Party A’s stipulation. 七、 乙方責(zé)任 Article Seven Party B’s Responsibility 7.1 乙方必須認(rèn)真工作和

14、勞動，保質(zhì)保量地完成自己的生產(chǎn)任務(wù)。 Party B must work earnestly and accomplish its own tasks with quality and quantity. 7.2 乙方必須如實匯報工作，積極配合和協(xié)助上級的工作。 Party B must report its job according to the facts and shall cooperate with its uppers and assist their jobs. 7.3 乙方應(yīng)嚴(yán)格履行甲方依法制定的規(guī)章制度和《員工手冊》。 Party B

15、shall strictly implement the rules and regulations and Handbook legally stipulated by Party A. 7.4 乙方應(yīng)愛護(hù)甲方的財物，對由于本人責(zé)任造成的直接經(jīng)濟(jì)損失，必須予以賠償并接受甲方的處罰。 Party B shall take good care of Party A’s property and he/she must indemnify direct damage due to his/her liability and accepts Party A’s punishment.

16、 7.5 乙方在勞動合同有效期內(nèi)未經(jīng)甲方事先書面同意，不得為另一家雇主工作。 Party B can not work for another employer without Party A’s written consent in the duration of Labor Contract. 7.6 乙方應(yīng)嚴(yán)格保守甲方的商業(yè)秘密，不得向任何第三方泄露。 Party B shall strictly keep Party A’s trade secret and can not divulge to any third party 7.7 如實陳述履歷和學(xué)歷

17、。 Party B shall state his/her curriculum vitae and educational background according to the facts. 7.8 如甲方委派乙方培訓(xùn)（包括海外培訓(xùn)），乙方必須遵守甲方的培訓(xùn)條規(guī)和承諾。 Party B shall observe Party A’s training rules and undertaking when Party A assigns Party B to be trained. 八、 甲方無償解除合同 Article Eight Cancellation of

18、 the Contract without Compensation by Party A 若符合下列情況之一的，甲方可以隨時解除合同，而不必給予乙方任何經(jīng)濟(jì)補(bǔ)償： Party A may cancel the Contract at any time without compensation to Party B under the following circumstances: 8.1 當(dāng)乙方在試用期內(nèi)不符合甲方的職工錄用條件，甲方無須給予乙方解除的原因。 When Party B is proven to be unqualified for Party A’s e

19、mployment conditions during probation period, Party A need not give Party B the reason for cancellation. 8.2 乙方嚴(yán)重違反甲方依法制定的規(guī)章制度和勞動紀(jì)律。 Party B seriously violates rules and regulations, labor discipline legally stipulated by Party A. 8.3 乙方嚴(yán)重失職，營私舞弊，給甲方利益造成重大損失。 Party B seriously neglec

20、ts his/her duty and grafts resulting in Party A’s great loss. 8.4 乙方違反中國法律，受到司法處罰或追究刑事責(zé)任。 Party B violates the laws of PRC and gains judicial punishment or is found a guilty. 九、 甲方有償解除合同 Article Night Cancellation of the Contract with Compensation by Party A 有下列情形之一的，甲方可以解除勞動合同，但是應(yīng)當(dāng)提前30天以書面形

21、式通知乙方或支付一個月基本工資代替，并依法支付乙方經(jīng)濟(jì)補(bǔ)償金或補(bǔ)助費。 Under the following circumstances, Party A may cancel the Contract with 30 days prior written notice to Party B or paying one month basic wage instead and legally pay economic compensation or subsidy to Party B. 9.1 乙方患病或非因工受傷，醫(yī)療期滿后仍不能從事原工作或由甲方另行安排的工作的。 P

22、arty B is ill or non-work-related injured, and unable to do the former job or other job assigned by Party A after medical treatment. 9.2 乙方不能勝任工作，經(jīng)過培訓(xùn)或調(diào)整工作崗位，仍不能勝任的。 Party B is not competent for the job and still remains so after training or adjustment of the post. 9.3 本合同訂立時所依據(jù)的客觀情況發(fā)生重大變化

23、，致使本合同無法履行，甲乙雙方不能就變更本合同達(dá)成協(xié) 議的。 The basis for the conclusion of the contract has greatly changed so that the contract can no longer be carried out, while both parties can not reach an agreement on modifying the contract by mutual negotiation. 9.4 甲方瀕臨破產(chǎn)，進(jìn)入法定整頓期間或者生產(chǎn)經(jīng)營狀況發(fā)生嚴(yán)重困難，達(dá)到當(dāng)?shù)厝嗣裾?guī)定的嚴(yán)重困難企 業(yè)標(biāo)準(zhǔn)

24、，確須裁減人員，并按法定程序解除勞動合同的。 Party A is close to bankruptcy and enters into legal rectification period or it is in a severe difficulty to meet the standard of severe difficult enterprise stipulated by the local government and the retrenchment is needed, and then Party A cancels the contract according to

25、legal procedure. 十、 乙方要求解除合同 Article Ten Cancellation of the Contract at Party B’s request 10.1 乙方要求解除勞動合同，應(yīng)當(dāng)提前三十天以書面形式通知甲方，但必須依照11.2條款賠償甲方。 Party B shall give 30days prior written notice to Party A when requesting to cancel the Contract, but he/she shall indemnify Party A according to Ar

26、ticle 11.2. 10.2 乙方在下列情況下，可隨時通知甲方解除勞動合同。 Under the following circumstances, Party B may inform Party A to terminate the Contract at any time. a. 在試用期內(nèi)。 Be in probation period. b. 甲方不按照勞動合同支付勞動報酬或者提供勞動條件的。 Party A didn’t pay the remuneration or provide working conditions according to the C

27、ontact. c. 甲方以暴力威脅或者非法限制人身自由的方法強(qiáng)迫乙方工作的。 Party A forces Party B to work by means of force, threat or illegal restriction of personal freedom. 十一、 違約責(zé)任 Article Eleven Liability for Breach of Contract 11.1 甲方依第9條提前解除合同，應(yīng)按法律規(guī)定向乙方支付經(jīng)濟(jì)補(bǔ)償金。 Party A shall legally pay economic compensation t

28、o Party B when canceling the Contract pursuant to Article Night. 11.2 乙方違約不履行合同，應(yīng)按《培訓(xùn)合同》的約定及法律法規(guī)的規(guī)定賠償甲方的經(jīng)濟(jì)損失。 Party B shall indemnify Party A for its economic loss according to laws and regulations and Training Agreement when he/she breaches the Contract. 十二、 合同附件 Article Twelve Annexes o

29、f the Contract 12.1 本合同的附件為本合同不可分割的組成部分，與本合同具有相等的法律效力。 The Annexes are indivisible parts of this contract and they have the same effect as this contract. 12.2 甲方依法制定的《員工手冊》及各項規(guī)章制度是本合同的附件。 Handbook and other rules and regulations legally stipulated by Party A are annexes of this Contrac

30、t. 十三、 勞動爭議 Article Thirteen Labor Dispute 甲乙雙方若發(fā)生勞動爭議，應(yīng)通過友好協(xié)商解決；若不能解決，可以向當(dāng)?shù)赜泄茌牂?quán)的勞動爭議仲裁委員會申請仲裁；對仲裁不服的，可向人民法院起訴。提出仲裁的一方應(yīng)當(dāng)在勞動爭議發(fā)生之日起60天內(nèi)向勞動爭議仲裁委員會提出書面申請；當(dāng)事人對仲裁裁決不服的，可以在收到仲裁裁決書之日起15天內(nèi)向人民法院起訴。 If labor dispute occurs, both parties shall resolve it through consultation. In case of failing to reach

31、an agreement, each party may submit the dispute to Labor Dispute Arbitration Committee having jurisdiction. If rejecting the award, each party can take a proceeding. The party applying for arbitration shall submit the arbitration application to Labor Dispute Arbitration Committee within 60 days when

32、 the labor dispute arises. If rejecting the award, the party can sue to the court within 15 days after receipt of the award. 十四、 合同生效 Article Fourteen Effectiveness of the Contract 本合同自甲、乙雙方簽訂后生效。并呈送有關(guān)鑒證單位鑒證。 This contract is effective by signatures of both parties and shall be submitted to th

33、e surveyor. 十五、 其它 Article Fifteen Miscellaneous 15.1 本合同未盡事宜，可由甲、乙雙方另行訂立補(bǔ)充條款，補(bǔ)充條款與本合同具有相同的法律效力。 If there is something unclear, both parties may conclude a supplement clause and the clause shall have the same effect as this contract. 15.2 在合同履行中，發(fā)生其他事項而本合同未明確的，按國家和地方有關(guān)法規(guī)執(zhí)行。有關(guān)條款如國家和地方有

34、 新的法規(guī)規(guī)定，按新的規(guī)定執(zhí)行。 If there is something undefined in this contract when implementing this contract, IT SHALL BE EXECUTED ACCORDING TO RELEVANT LAWS AND REGULATIONS OF THE STATE AND REGION. If there is a new stipulation per relevant clauses, they shall be carried out pursuant to aforesaid sti

35、pulation. 15.3 本勞動合同的變更須經(jīng)甲、乙雙方協(xié)商同意，并辦理合同變更手續(xù)，合同變更的內(nèi)容，可由雙方商定。 The modification of this contract shall be mutually agreed by both parties and shall be facilitated with the relevant procedure.
